This agreement is established between the user and O Mercado Digital.

1. About O Mercado Digital
O Mercado Digital is an online platform that acts as an intermediary between companies or individuals and independent service providers. Project owners can publish job requests, and freelancers can submit proposals, negotiate, and perform tasks through the platform.
By using this platform, you acknowledge that you have read, understood, and agreed to the Terms of Use and Privacy Policy in full.
2. Acceptance of Terms
Your use of the platform constitutes your explicit and direct acceptance of all terms and conditions contained in this document. If you do not agree with any of the terms, you must immediately stop using the platform.
3. Electronic Communications
When you use the platform or communicate with us via email or other digital means, you acknowledge that such interactions qualify as electronic communications. You agree to receive notifications, documents, and information electronically in compliance with legal requirements.
4. User Account
Some features of the platform may require creating a user account. You are fully responsible for maintaining the confidentiality of your login information and for all activities that occur under your account.

6. Platform Operations and Payments
The platform allows job postings, proposal submissions, and negotiation between users. Prices, deadlines, and work conditions are agreed upon directly between the client and the freelancer.
Once the work is completed and approved by the client, payment will be released to the freelancer after deducting the applicable service fee.
7. Cancellation and Refund Policy
Both parties may cancel a project at any time. If funds are being held in escrow, the amount will be returned to the rightful party after dispute review to prevent abuse and fraud.
If a client cancels a project after delivery of the work simply to avoid payment, the freelancer may file a claim with the support team.
8. Privacy Policy and Data Protection
O Mercado Digital is committed to protecting user data in accordance with Brazil’s General Data Protection Law (LGPD). Information we may collect includes: name, email, phone number, CPF/CNPJ, address, professional data, browsing data, and usage information.
Data may be used for the following purposes:
- Account creation and platform usage.
- Communication between clients and freelancers.
- Compliance with legal and tax obligations.
- Platform optimization and user experience improvement.
- Sending notifications and essential information.
Data may be shared with technical partners or official authorities when legally required.
9. Cookies
The platform uses cookies to improve user experience and collect analytical data. You may disable cookies in your browser settings, but doing so may affect certain website features.

Users agree to indemnify and hold O Mercado Digital harmless from any damages or losses arising from misuse of the platform or violation of these terms.
15. Changes to the Terms
The platform may update these terms at any time. Continued use after such updates constitutes acceptance of the revised terms.
16. Governing Law and Jurisdiction
These terms are governed by the laws of Brazil, and any disputes shall be resolved before the courts of Florianópolis / SC – Brazil.
